Notice of the Department of Soil and Water Conservation of the Ministry of Water Resources on the issuance of provisions on the examination and acceptance of soil and water conservation programs and the supervision and inspection of clean government (trial)

　　Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on Water and Soil Conservation and its implementing Regulations for the purpose of strengthening the acceptance of water and soil conservation facilities of development and construction projects。

　　Article 2 These Measures shall apply to the acceptance of water and soil conservation facilities of development and construction projects for which reports on water and soil conservation plans are prepared。

　　The acceptance of water and soil conservation facilities of development and construction projects for which reports of water and soil conservation plans are compiled may be carried out with reference to these Measures。

　　Article 3 The competent department of water administration of the local people's government at or above the county level where a development and construction project is located shall regularly supervise and inspect the implementation of the water and soil conservation program and the operation of water and soil conservation facilities。

　　Article 4 A development and construction project may not be formally put into production or use until the experience of water and soil conservation facilities is qualified。

　　Article 5 The department of water administration of the people's government at or above the county level or the institution entrusted by it shall be responsible for the organization, implementation, supervision and administration of the acceptance inspection of water and soil conservation facilities for development and construction projects。

　　The department of water administration of the people's government at or above the county level shall be responsible for the acceptance of water and soil conservation facilities for development and construction projects in accordance with its authority of examination and approval of water and soil conservation plans。

　　The materials for acceptance of water and soil conservation facilities organized by the competent department of water administration of the local people's government at or above the county level shall be reported to the competent department of water administration of the people's government at the next level for the record。

　　Article 6 The scope of acceptance of water and soil conservation facilities shall be consistent with the approved water and soil conservation plan and the approved documents。

　　The main contents of the acceptance of soil and water conservation facilities are as follows: check whether the soil and water conservation facilities meet the design requirements, construction quality, investment and use, and the implementation of management and maintenance responsibilities, evaluate the effect of prevention and control of soil erosion, and put forward suggestions on the treatment of existing problems。

　　Article 7 Water and soil conservation facilities shall be determined as having passed the acceptance inspection only if they meet the following conditions;

　　(1) The examination and approval procedures for water and soil conservation programs of development and construction projects are complete, and the data on water and soil conservation engineering design, construction, supervision, financial expenditure and soil erosion monitoring reports are complete;

　　(2) The water and soil conservation facilities shall be completed in accordance with the requirements of the approved water and soil conservation plan report and design documents, and shall meet the requirements of the main construction, process and water and soil conservation;

　　(3) the indicators such as the degree of treatment, slag retention rate, plant recurrence rate, and soil and water loss control amount have reached the requirements of the approved soil and water conservation program and the approved documents and the relevant national and local technical standards;

　　(4) Water and soil conservation facilities have normal operating conditions, and can operate continuously, safely and effectively, and meet the requirements for delivery and use。Implementation of management and maintenance measures for water and soil conservation facilities。

　　Article 8 After the completion of the civil engineering of a development and construction project, the acceptance of water and soil conservation facilities shall be carried out in a timely manner。The construction unit shall work together with the unit preparing the water and soil conservation plan，According to the approved water and soil conservation plan report, design document content and project quantity，To inspect the completion of soil and water conservation facilities，To prepare a summary report on the implementation of the water and soil conservation plan and a technical report on the completion and acceptance of water and soil conservation facilities (see the annex for the outline)。For those who meet the acceptance conditions listed in Article 7 of these Measures, an application for acceptance inspection of water and soil conservation facilities may be submitted to the organ that examined and approved the water and soil conservation program。

　　Article 9 Where the water administration department under The State Council is responsible for the acceptance of development and construction projects, the water administration department under The State Council shall entrust relevant technical institutions to carry out technical assessment。

　　Provincial water administrative departments responsible for the acceptance of development and construction projects, may be implemented according to the specific circumstances with reference to the provisions of the preceding paragraph。

　　The local and county-level water administrative departments responsible for the acceptance of development and construction projects may directly carry out the completion acceptance。

　　Article 10 Institutions undertaking technical assessment shall organize experts in soil and water conservation, hydraulics, plants, finance and economy, etc., to evaluate water and water conservation facilities in accordance with the approved water and water conservation programs, approval documents and acceptance procedures for soil and water conservation, and submit assessment reports。

　　Article 11 The competent department of water administration of the people's government at or above the county level shall, after accepting the application for acceptance inspection, organize representatives and experts of the relevant units to set up an acceptance group, inspect the construction site according to the application for acceptance inspection, relevant results and materials, and put forward opinions for acceptance inspection。Among them, in accordance with the provisions of Article 9 of these measures, the development and construction projects that need to be evaluated first, the construction unit shall attach the technical evaluation report when submitting the application for acceptance。

　　Construction unit, soil and water conservation plan preparation unit, design unit, construction unit。Supervision units and monitoring report preparation units shall participate in on-site acceptance。

　　Article 12 The acceptance opinions shall be agreed by more than two-thirds of the members of the inspection group, and the members of the inspection group and the representatives of the units to be inspected shall sign the acceptance documents。

　　Article 13 The water administrative department of the people's government at or above the county level shall, within 20 days from the date of accepting the application for acceptance, make a conclusion on acceptance。

　　For the project that has passed the acceptance inspection, the water administrative department shall handle the acceptance inspection formalities within 10 days from the date of making the acceptance inspection conclusion, which shall be one of the important bases for the completion inspection of the development and construction project。

　　For the project that fails to pass the acceptance inspection, the water administrative department responsible for the acceptance inspection shall order the construction unit to make rectification within a time limit until it passes the acceptance inspection。

　　Article 14 For development and construction projects that are constructed by stages, put into production or use by stages, the corresponding soil and water conservation facilities shall be checked and accepted by stages in accordance with these Measures。

　　Article 15 After the water and soil conservation facilities have passed the acceptance inspection and been put into use, the construction unit or operation and management unit shall strengthen the management and maintenance of the water and soil conservation facilities to ensure their safe and effective operation。

　　Article 16 Violation of these Measures，Water and soil conservation facilities have not been completed, have not been inspected or have failed to pass the inspection，The main part of the project has been put into operation，The competent department of water administration that has examined and approved the water and soil conservation scheme of the construction project shall order the completion of the relevant works within a time limit and go through the procedures for acceptance，Overdue，A fine of up to 10,000 yuan can be imposed。

　　Article 17 The expenses related to the acceptance of water and soil conservation facilities of a development and construction project shall be borne by the project construction unit。

　　Article 18 The Ministry of Water Resources shall be responsible for the interpretation of these Measures。

　　Article 19 These Measures shall come into force as of December 1, 2002。
